Who Uses a Landscaping Receipt?
Any business or landscaping technician that provides services enhancing, modifying, and repairing the outdoor landscape of a piece of property. These types of services include but aren’t limited to the following:
- Construct patios, ponds, and walking paths;
- Install outdoor lighting;
- Install sprinkler systems;
- Plant and maintain flowers, hedges, lawns, succulents, trees, or any other flora and fauna;
- Plant and mow lawns.
Are Landscaping Services Subject to Sales Taxes?
When a landscaper gets paid as an independent contractor, their services are subject to state sales taxes in the following states:
- Connecticut, Delaware (gross receipts tax), Hawaii, Iowa, Kansas, Kentucky, Minnesota, New Jersey, New Mexico, Ohio, Pennsylvania, South Dakota, Washington, Washington, D.C., West Virginia, and Wisconsin.
However, more often than not, the IRS categorizes landscapers as household employees instead of independent contractors. If a landscaper earns more than the IRS-established minimum from a single employer ($2,400/year or $1,000/quarter for 2022), the employer has to withhold household employment taxes from their fees. This group of taxes is more casually known as the “nanny tax.” The nanny tax comprises federal and state income taxes, FICA taxes (Medicare and Social Security), and unemployment insurance.
